Abstract

 

Summary

The obligation to inform the media is one of the modern topics that men of positive law have given importance to, in light of the technical and technological development, the lack of knowledge parity between contracting parties, and the absence of a text in the general law of the contract that explicitly stipulates this obligation and regulates the provisions.

The obligation to inform before contracting achieves the necessary ethical foundations for daily transactions between contracting parties. Enlightening the contracting party with the essential information related to the contract makes him decide later whether to conclude the contract or not to conclude it, assuming one of the two parties to the negotiation depends primarily on the suitability of the contract to his needs and the purpose of concluding it in the first place, which results in, The obligation to inform has a preventive role, represented by preventing contractual risks before concluding the contract. This obligation also works to address the damages resulting from the contract if they occur, or at least to prevent their aggravation.
